On October 7, 2020, Governor Greg Abbott issued Executive Order No. GA-32 (“Executive Order”). The Executive Order addressed several topics, including occupancy for business establishments; occupancy limits for outdoor areas, events, and establishments; indoor and outdoor professional, collegiate, and similar sporting events; outdoor gatherings in excess of 10 people; restaurants; bars or similar establishments; and more.

With regard to bars or similar establishments that hold a permit from the Texas Alcoholic Beverage Commission (“TABC”), Governor Abbott has extended authority to the County Judges of counties that are not in an area with high hospitalizations to allow such establishments to offer on-premises services at up to 50 percent of the total listed occupancy of the establishment. However, this is dependent on the Office of the County Judge filing a requisite form with the TABC.

In addition, there are specific protocols that the establishments and patrons must follow, as outlined in the Executive Order and the Texas Department of Health and Human Services. These protocols can be reviewed by clicking on the links below.
