Instructions to Bidder - General Terms & Conditions

Bid Name/ Bid No.: Sale of Real Property of a 0.39 Acre Tract of Land

Please read these instructions thoroughly and be sure that your offer complies with all requirements.  Sealed bids will be received for "Sale of Real Property of a 0.39     Acre Tract of Land" in accordance with the specifications attached hereto.

            A legal description of the land the subject of this bid package is attached hereto as Exhibit “A.”

1.         Bid responses must be enclosed in a sealed envelope with the bidder's name and return address clearly typed/printed and proper notation clearly type/printed stating “Sale of Real Property” and delivered to the City of the Mineola City Hall located at 300 Greenville Avenue, Mineola, Texas, 75773, before 5:00 p.m. CST, July 2nd, 2020. No Facsimiles or late arrivals will be accepted. Any bid received after that time will not be opened and will be returned.

2.         Bids must give the full firm name and address of bidder, and be manually signed. Failure to do so will disqualify your bid. The Person signing the bid must show title or AUTHORITY TO BIND HIS ENTITY IN A CONTRACT. Entity name and authorized signature must appear on each page that calls for this information.

3.         Bids cannot be altered or amended after opening time. Alterations made before opening time must be initialed by bidder guaranteeing authenticity. No bid may be withdrawn after opening time without acceptable reason in writing and only after approval by the City of Mineola.

4.         The City and the awarded bidder will negotiate and execute a contract for sale concerning the property.  Payment in full will be required by the bidder at closing.

5.         Bidders are required to hold their bids firm for a period of sixty (60) days following bid submission.

6.         The City of Mineola reserves the right to reject any or all bids, to waive any or all formalities or technicalities, and to make such awards of contract as may be deemed to be the best and most advantageous to the City of Mineola.

7.         Should bidders be in doubt as to the bid process, he/she should at once notify the City Secretary and obtain clarification prior to submitting any bid.

NAME AND ADDRESS

A 0.39 acre parcel of land located in Mineola, Texas.  Said property is located in Wood County, Texas and is further described as Lots 6, 7, 8B BLK 21, Mineola Townsites, corner of W. Buchanan and Hogg St.

PROPERTY WILL BE EVALUATED AND AWARDED INDIVIDUALLY THEREOF.

The property will be sold to the highest bidder "AS IS". The City offers no warranties expressed or implied. Bidder's attention is directed to the fact that careful and thorough inspection must be made prior to bidding as any defects discovered after bid date and time are the responsibility of the successful bidder.

Bidder is responsible for satisfying itself as to the status of the title to the property, the status of the payment or nonpayment of the ad valorem taxes on the property and otherwise conducting due diligence on the condition, merchantability, suitability for fitness for a particular purpose.  It is the bidder's responsibility to check the title. The City will convey the title subject to all encumbrances, liens and taxes, if any. Those liens, encumbrances and taxes, is any, will become the responsibility of buyer. The City will pay for preparation of a contract for sale and deed only. Closing cost fees will become the responsibility of buyer. The successful bidder will take ownership of said property as is.

The City of Mineola reserves the right to refuse and reject all bids and to waive any or all formalities or technicalities or to accept the bid to be the best and most advantageous to the City. Bids submitted past the aforementioned date and time will not be accepted.

The City of Mineola will not be responsible for any incorrectly addressed or misplaced bids.
